TARIFF
for FLEXWAY TRUCKING, INC.
Effective
March 1, 2008
Services
and fees shown included herein serve as a reminder as to some additional services that Flexway can offer in conjunction with
the line-haul performance. Existing services and fees specifically provided
for in a customer’s tariff or contract rate proposal shall take precedence.
1. INSURANCE: Upon request, Carrier shall provide certificates of insurance and shall maintain public
liability insurance in the amount of not less than $1,000,000, and cargo insurance in the amount of not less than $100,000
per shipment.
2. CARGO
RULES: Cargo rules apply in accordance with the uniform straight domestic bill of lading on all shipments and supersedes what
is written on the Bill of Lading or Shipping document. Standard claims
rules applicable to common carriers apply.
3. The following
charges apply for services unless other otherwise agreed:
- For services in the greater metro area, hourly rates apply, for services beyond the greater metro
area, rates are based on per-mile charges.
- The per-mile rate is $1.75 per mile and applied to round trip miles plus any applicable fuel adjustment
charges and other applicable service charges. The charges apply from the originating
terminal of the truck until the truck is returned to its originating terminal.
- Mileage determination is by the practical miles for PC-Miler software.
- Maximum weight per load is 45,000 pounds per trailer.
- Minimum charge per shipment is $500 per shipment.
- Flexway’s liability for new cargo shall be limited to a maximum of $100,000.00 per trailer load
limited to fifty cents per pound unless otherwise agreed. For used or reconditioned
cargo, the cargo liability shall not exceed five cents per pound of actual shipment
weight per trailer.
- Driver requested to physically load or unload at customer is assessed a charge $0.12 per case
handled with a minimum charge of $90.00.
- Stop-off en-route for pickup or unload is $90.00 for the first service, $145.00 for the second
service and $190.00 for each successive stop thereafter. When stopped
at points not directly intermediate between origin and destination the excess miles shall be subject to an additional charge
of $1.75 per mile plus applicable fuel surcharges.
- For a trailer only, dropped at the loading origin or unloading destination,
there shall be allowed 24 hours free time from the time Flexway delivers the trailer to shipper or consignee
location. Upon expiration of free time, a fee of $72.00 per 24-hour period or fraction thereof shall be assessed. A service charge of $25.00 plus $1.40 per mile (subject
to a total minimum charge of $50.00) plus applicable fuel surcharge for the miles necessary to effect obtaining
pickup the dropped trailer.
- Loading at origin or unloading at destination or for stop-off en-route shall
be allowed one hour free time. Upon expiration of free time in each instance, a fee of $77.50 per hour or portion thereof
shall apply. Charges stated in this paragraph shall be subject to a maximum charge of ten hours per 24-hour period.
- Equipment ordered and not used is subject to a charge of $1.75 per mile subject to a minimum
of $325.00 per occurrence plus applicable fuel surcharge.
- Re-delivery charge is subject to a charge of $1.75 per mile with a minimum of $325.00 plus applicable fuel
surcharge.
- To obtain the weight of a trailer, a charge of $25.00 applies plus $1.75 per mile (subject to a total minimum charge of $50.00) plus applicable fuel surcharge for
the miles necessary to effect obtaining the weight of the trailer.
- A loaded trailer held at a Flexway facility shall be allowed 24 hours free
time beginning on the date of arrival that notice is given. Upon expiration of said free time, a fee of $60.00 per 24-hour
period, or fraction thereof shall apply.
- Storage charge for a pallet is $5.00 per day. Storage
charge for a trailer load of pallet merchandise on a Flexway designated storage trailer is $40.00 per day.
- When a trailer is dropped at a customer facility or at a destination through
no fault of the Carrier and an empty trailer cannot be picked up at the delivery location, a charge of $1.75 per mile, subject
to a minimum of $325.00, plus applicable fuel surcharge and detention apply to pickup the trailer at a later time plus the
daily charge for the dropped trailer.
- Hazardous DOT commodities incur a twenty-two percent charge over applicable rates.
- Payment for services without offset is due to Carrier within fourteen (14) calendar days from
invoice date. A service charge of one-half of one percent per week shall apply
for each week, or portion thereof, beyond twenty-one (21) calendar days after receipt of payment.
- The hourly rate for a driver and tractor without a trailer is $68.00 per hour or portion thereof
and applies in the greater St. Louis, MO metro area. The hourly rate for a driver and
tractor with a trailer is $82.00 per hour or portion thereof and applies in the greater St.
Louis, MO metro area.
- The fuel adjustment charge is applied as a percent of the rates charged. The fuel adjustment charge begins at $1.10 per gallon.
Fuel price change is measured by the US On-Highway Diesel Prices as published weekly by the DOE. The fuel adjustment
charge is effective for the week in which the DOE publishes the US On-Highway Diesel price.
For each $0.10 that the fuel price rises above $1.00, the fuel surcharge is 1%. Following
are examples of fuel price change points and the fuel surcharge: when the fuel price rises to $1.10/gal a fuel surcharge of
1% applies; when the fuel price rises to $1.20/gal a charge of 2% applies; when fuel price rises to $1.30/gal a charge
of 3% applies; The following chart is for reference and may exceed the
chart.
